Terms and Conditions of Use and Service for The Business Quintet

These Terms and Conditions ("Terms") govern your use of The Business Quintet's website (thebusinessquintet.au), our video courses, and our one-on-one consulting packages (collectively, the "Services"). By accessing or using our Services, you ("you" or "User") agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.  

2. Description of Services  

The Business Quintet offers:

  • Video Courses: Online video workshops covering topics such as business planning, marketing planning, business setup, business communications, and business growth. Each course includes video content and downloadable templates.

  • One-on-One Consulting Packages: Personalised consulting services provided through individual sessions, including business reviews and recommendations documents and hands on application of technologies.

3. User Accounts 

If you create an account on our website to access video courses, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.  

4. Payment and Fees

Fees for video courses and consulting packages are as specified on our website or in individual agreements.All payments are processed securely through our chosen payment gateway. You agree to pay the applicable fees for the Services you purchase.

5. Non-Refundable Policy

  • Video Courses: Due to the digital nature of our video courses and the immediate access granted upon purchase, all sales are final and non-refundable once access has been provided.

  • One-on-One Consulting Packages: Once a consulting package has commenced (including the initial session or any work undertaken by The Business Quintet), all fees paid are non-refundable. If you need to reschedule a session, you must provide 24 hours prior notice. Failure to provide sufficient notice may result in the forfeiture of that session.

6. Intellectual Property Rights

  • All content included in the Services, such as video recordings, written materials, templates, logos, and trademarks, are the sole property of The Business Quintet (Cait Fleming) and are protected by Australian and international copyright and other intellectual property laws.

  • Upon purchasing a video course or consulting package, you are granted a single, non-exclusive, non-transferable license to access and use the content for your personal or internal business use only.

  • You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content from our Services without the prior written consent of The Business Quintet.  

  • Specifically, the templates provided with the video courses and within consulting packages are for your internal business use only and may not be shared, sold, or distributed to third parties.

7. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose.

  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.

  • Attempt to gain unauthorised access to any part of the Services or any other systems or networks connected to the Services.  

  • Upload or transmit any viruses, worms, or other malicious code.

  • Infringe upon the intellectual property rights of The Business Quintet or any third party.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Business Quintet does not warrant that the Services will be uninterrupted, error-free, or completely secure.  

9. Limitation of Liability

To the maximum extent permitted by law, The Business Quintet (Cait Fleming) shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or inability to access or use, the Services. Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to The Business Quintet for the specific Service in question.  

10. Indemnification

You agree to indemnify, defend, and hold harmless The Business Quintet (Cait Fleming) and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms or your use of the Services.  

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.  

12. Changes to These Terms

The Business Quintet reserves the right to modify or revise these Terms at any time without prior notice. Your continued use of the Services following the posting of any changes constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.
